Executive Summary

 

1.1     Reasons for the Report

 

At the Council meeting of 4 February 2015, Council resolved:

 

To have full Council determine any subdivisions greater than 5 lots that falls outside the growth areas of Austral, Leppington North, Edmondson Park and Middleton Grange.

 

This development application is for a subdivision creating 16 lots and is located outside of the growth areas identified in the Council resolution.

 

1.2     The Proposal

 

This development application seeks Council approval for the subdivision of Lots 31 and 32 in DP 1181985 in two stages.

 

Stage 1 seeks approval for a Torrens title boundary adjustment subdivision to create 2 lots being Lot 21 for an existing golf course and residue Lot 22 for further development (subject to Stage 2). Stage 2 seeks approval for the Community title subdivision of residue Lot 22 created by Stage 1 to create 1 community lot (Lot 1), 13 residue lots for future residential development (Lots 2 to 14), 1 lot for the existing communications tower (Lot 15), 1 lot to be created as drainage reserve (Lot 16), new roads and associated bulk earthworks, tree removal and services.

 

The proposal is a permissible land use and has planning merit. On this basis, this report recommends approval of the Development Application subject to recommended conditions of consent.

 

RECOMMENDATION

 

That Council approves Development Application DA-426/2014 subject to the recommended conditions of consent attached to this report.

 

REPORT

 

Development Application DA-426/2014 seeks consent for the subdivision of Lots 31 and 32 in DP 1181985 in two stages.

 

Stage 1 is a Torrens title boundary adjustment subdivision to create 2 lots being Lot 21 for an existing golf course and residue Lot 22 for further residential development. This subdivision is required to correct some minor inconsistencies between the current land boundaries and the zone boundaries for the New Brighton Release Area development. This subdivision is a facilitating subdivision only and does not require any adjustment to any works or services on site. 

 

The Stage 2 development includes the creation of roads and superlots which will become the first stage of the residential portion of the New Brighton Residential Release Area development. This development will include earthworks, the construction of roads, drainage and other services required for the future residential dwellings to be erected in the release area.

 

Stage 2 of the development will create residue lots only at this time and does not include the construction of any dwellings. The proposed superlots will be further subdivided for residential housing, subject to future development applications.

 

The planning officers development assessment report is attached which addresses the matters for consideration as required by Section 79C of the Environmental Planning and Assessment Act 1979.
